General Public is hereby informed that B. R. Dhawan Memorial Charitable Trust is the owner in title and possession of the BENSUPS Hospital (BH) at Sector 12 Dwarka, New Delhi. M/s Cygnus Medicare P. Ltd. (CMPL) earlier entered into a Medical Services Agreement (MSA) with the Trust on 22/09/2011 to the limited extent of providing certain Medical Services. The said agreement was also terminated on 05/09/2012. The owners of BH have also challenged the aforesaid MSA as the one obtained by fraud & misrepresentation by filing C.S. No. 292/2013 pending on the file of the Hon'ble Delhi High Court. View More y interim order dated 31/08/2012 from the Court of Ld. ADJ-IV Dwarka Courts and also got a Receiver appointed. The said interim order was vacated by an order dated 07/08/2014 in CS No 207/2014 by the Hon'ble Court of Sh. R. K. Tripathi ADJ-IV Dwarka Courts while dismissing the aforesaid application u/s 9 of the Act holding that the complete control over the hospital continues with the Trust. The FAO No. 237/2014 by the CMPL assailing the said order before the Hon'ble Delhi High Court was also dismissed on 13/08/2014. The application filed by CMPL for the stay of the suit (CS 292/13) u/s 8 of Arbitration Act was also earlier dismissed by the Delhi High Court on 09/12/2013. The SLP No. 3129/2014 filed by CMPL before the Hon'ble Supreme Court challenging the above order & for interim protection was also dismissed on 22/08/2014. The General Public is hereby further informed that the owners of the BENSUPS Hospital are already in possession of the hospital and its premises to have control pursuant to the above developments and are neither responsible nor liable for any actions / dealings of CMPL misusing the Trust name and the Hospital.
